Every user using ElectionChamp must comply to the Terms of Service
You agree to be governed by the following terms and conditions (“Terms of Service”) by using the ElectionChamp.com website (“Service”), all services of Frendeal Inc. (“ElectionChamp”).
ElectionChamp retains the right to modify and revise the Terms of Service without prior notification. You may always examine the most up-to-date version of the Terms of Service at https://electionchamp.com/terms-of-service.
You must be a human. Accounts created using “bots” or other automatic means are prohibited.
You’re responsible for keeping your Account and password secure. ElectionChamp is not responsible for any loss or damage resulting from your failure to comply with this security requirement.
You are liable for any and all activity that occurs under your Account.
You are prohibited from using the Service for any unlawful or unauthorized purpose. You may not use the Service in violation of any applicable laws in your jurisdiction.
Lastly, please refrain from using our Service to send unsolicited (“spam”) email.
Any violation of these terms and conditions may result in the closure of your Account and/or legal action.
A valid credit card is necessary to initiate elections exceeding a certain minimum threshold. You are not needed to give a credit card number until it is time to make a payment.
Your credit card information is transmitted directly to our payment processor, Stripe, without passing or storing via/on our computers.
Once an election has begun, there are no refunds, however ElectionChamp may, at its sole discretion, grant a credit towards the activation of future elections.
You are responsible for payment of any taxes, levies, or charges levied by taxing authorities that are not included in the fees.
ElectionChamp reserves the right, in its sole discretion, to suspend or terminate your Account and reject any and all current or future use of the Service, or any other ElectionChamp service, for any or no reason at any time.
ElectionChamp retains the right to alter or cancel, temporarily or permanently, the Service (or any portion thereof) at any time and without notice.
All Service prices are subject to change without prior notice.
ElectionChamp is not responsible to you or any third party for any modification, price change, suspension, or discontinuation of the Service.
We do not assert any intellectual property rights over the content you submit to the Service. Your profile and submitted items are yours. If you make your election results public, however, you consent to others viewing your information.
The design of the Service is protected by copyright 2022 Frendeal, Inc. All rights reserved You may not copy the appearance and feel of electionchamp.com, but you may reuse particular design pieces to support a vote utilizing the Service. For other usage, you must acquire our permission
Your usage of the Service is undertaken at your own risk. The Service is made available “as is” and “as available.”
You are prohibited from modifying, adapting, or hacking the Service or altering another website so as to fraudulently indicate that it is linked with the Service, ElectionChamp, or any other ElectionChamp service.
You undertake not to replicate, duplicate, copy, sell, resell or exploit any component of the Service, usage of the Service, computer code that runs the Service, or access to the Service, unless you get ElectionChamp’s prior written consent.
ElectionChamp disclaims any warranty or representation that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, and (v) any errors in the Service will be corrected.
You expressly understand and agree that ElectionChamp shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if ElectionChamp has been advised of the possibility of such damages);
ElectionChamp’s omission to exert or enforce any right or term of the Terms of Service shall not be construed as a waiver of such rights or provisions. The Terms of Service represent the whole agreement between you and ElectionChamp and govern your use of the Service, replacing any prior agreements between you and ElectionChamp (including, but not limited to, any previous versions of the Terms of Service).
You acknowledge and agree that as an administrator, you will provide some information about your voters in order to conduct the ElectionChamp voting process, including providing election notification, recording the vote, counting the winners, communicating the results, and validating the vote. ElectionChamp warrants that it will use commercially reasonable measures to preserve voter information and ensure the confidentiality of said information in accordance with https://electionchamp.com/privacy-policy.
